Expedited arbitration procedure

THESE SPECIAL RULES SHALL APPLY

  • IN CASES WHERE THE AMOUNT IN DISPUTE DOES NOT EXCEED EUR 50,000, UNLESS THE PARTIES AGREED OTHERWISE
  • IN CASES WHERE THE AMOUNT IN DISPUTE EXCEEDS EUR 50,000 IF THE PARTIES AGREED THAT THE PROCEEDING SHALL BE SUBJECT TO THE RULES ON EXPEDITED ARBITRATION
  • SHALL BE CONDUCTED BY A SOLE ARBITRATOR

STEP 1 - APPOINTMENT OF SOLE ARBITRATOR

PARTIES

  • SHALL APPOINT THE SOLE ARBITRATOR BY MUTUAL CONSENT WITHIN 15 DAYS

PRESIDENT OF ARBITRATION

  • APPOINTS THE SOLE ARBITRATOR IF THE PARTIES FAIL TO DO SO, WITHIN FURTHER 8 DAYS

STEP 2 - PROCEEDING

CLAIMANT

  • SUBMITS STATEMENT OF CLAIM
  • FOLLOWING SECRETARIAT'S REQUEST CLAIMANT SHALL PAY:
    • REGISTRATION FEE (IN THE AMOUNT OF 200 EUR)
    • THE COSTS OF ARBITRATION
  • TIME LIMIT FOR THIS PAYMENT IS TWO MONTHS
  • IF THE CLAIMANT FAILS TO PAY THE COSTS, THE CLAIM SHALL BE DEEMED WITHDRAWN

RESPONDENT

  • SUBMITTS AN ANSWER TO THE STATEMENT OF CLAIM WITHIN 15 DAYS FROM THE DATE OF RECEIPT

CLAIMANT

  • MAY STATE ITS POSITION REGARDING THE ANSWER TO THE STATEMENT OF CLAIM WITHIN 15 DAYS FROM THE DATE OF RECEIPT

RESPONDENT

  • MAY STATE ITS POSITION REGARDING WRITTEN SUBMISSION OF THE CLAIMANT WITHIN 15 DAYS

STEP 3 - HEARING

ORAL HEARING

  • AS A RULE, ONLY ONE HEARING SHALL BE HELD
  • IF THE SOLE ARBITRATOR DETERMINES THAT THE WRITTEN SUBMISSIONS AND EVIDENCE ARE SUFFICIENT FOR MAKING THE AWARD WITHOUT HOLDING A HEARING, AND IF NONE OF THE PARTIES REQUEST A HEARING TO BE HELD, THE SOLE ARBITRATOR SHALL MAKE THE AWARD WITHOUT HOLDING A HEARING, ON THE BASIS OF THE SUBMITTED EVIDENCE

STEP 4 - MAKING OF THE AWARD

THE ARBITRAL AWARD

  • THE SOLE ARBITRATOR SHALL MAKE THE ARBITRAL AWARD WITHIN 15 DAYS FROM THE DAY ON WHICH THE HEARING WAS HELD OR WITHIN 15 DAYS FROM THE DAY ON WHICH THE CONDITIONS FOR MAKING THE AWARD WITHOUT HOLDING A HEARING WERE FULFILLED
  • CONTAINS THE SUMMARY OF THE REASONS ON WHICH THE AWARD IS BASED, UNLESS THE PARTIES AGREED THAT THE REASONS SHOULD NOT BE STATED
